Guide on how to find a property for sale and to buy in Poland

The territory of Poland is bigger than the United Kingdom with a much smaller population. With economically vibrant major cities such as Warsaw, Cracow, or Gdańsk, and the property prices still much lower than in Western Europe, it is a great time to look for properties for sale here. If you are considering an investment in overseas property, perhaps buying an apartment in Poznań or Łódź may be a great idea – even if you struggle to pronounce it. Whether looking for a residential or business property in Poland, you must be prepared to buy property.

Who can buy a property?

There are no restrictions for EU citizens but buyers from non-EU countries must obtain a special permit. Until Brexit, British citizens enjoyed the right to buy without this requirement, however, now the Polish state expects them to apply for it. The application is submitted to the Ministry of Internal Affairs and should contain the details about the applicant, their legal status, the property, the seller, and an explanation of the purpose.

You do not need to be a resident to buy a dream home, luxurious villa, or office building in Poland.

The listings are available on national and local property portals with homes for sale in Poland such as Gratka or Otodom. To find a suitable apartment, plot, or house for sale, you can opt for a reputable estate agent who will guide you through the process. Working with a person you trust will make the search for property in Poland much easier especially, if you live abroad. 

What to look at in the property ads?

A typical real estate advertisement in the United Kingdom would give you information on whether it is a freehold or a leasehold, the number of bedrooms and bathrooms, the living room is rarely mentioned, and an asking price. In Poland the property regime is different, and you need to look carefully at the legal status of a Polish property. The number of rooms includes bedrooms and the living area, the price is given per square meter, and it lists all usable areas, e.g. a storage or parking spot. The plots would be listed in hectares.

Due diligence is key

When searching for a dream home in Poland always make sure you verify the property. Prices in Poland may be tempting but caution when buying real estate is universal. Make sure that the picturesque villa in the Polish countryside or a luxurious apartment in the city centre is as good in reality as on the picture. 

You can request access to the Land and Mortgage Register to check whether there are any mortgages, servitudes, or legal issues with the property. Check the local amenities such as transport links, local schools, or leisure facilities. If you are interested in purchasing a new development, get legal assurances on the final price, what it includes, and the completion date.

Documents needed for buying property in Poland

When buying a new home or other property type, you need proof of identification, e.g. a passport, the permit if necessary, and the purchase agreements. Before completing the transaction, you may ask for a valuation survey conducted by a real estate appraiser or other technical documents.

The transaction takes place at a Notary’s Office, and you will be asked to present certified translations of the documents. In Poland, there is a list of professional translators and interpreters sworn by the Polish Minister of Justice. As a foreigner you are unlikely to understand Polish legalese and the Notary will request the presence of a certified interpreter when you sign the contract.

Once the agreement is completed, the buyer is obliged to update the records in the Land and Mortgage Register and pay all taxes due. The notary will be able to help you with these.
